Please read these Terms of Service carefully before using CalBuddy. By downloading, installing, or using the app, you agree to be bound by these terms. If you do not agree, do not use CalBuddy.

1. Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and CalBuddy ("we," "us," or "our") governing your use of the CalBuddy mobile application and any related services (collectively, the "Service").

By accessing or using CalBuddy, you confirm that you are at least 13 years of age (or 16 in the EU), have read and understood these Terms, and agree to be bound by them.

2. Description of Service

CalBuddy is a calorie and nutrition tracking application that provides:

AI Food Analysis: Analyze meals via photo, text description, or barcode scan to estimate calories and macros
Nutrition Tracking: Log food intake and track daily calorie and macro goals
Weight Tracking: Record and visualize weight progress over time
Buddy System: Pair with a friend to view each other's daily calorie progress
iOS Widget: A shared home screen widget showing buddy progress
Guest Mode: Use the app locally without creating an account

3. User Accounts

3.1 Account Creation

You may use CalBuddy as a guest without creating an account. To access cloud sync, the buddy system, and the shared widget, you must create an account using your email address, Apple ID, or Google account.

3.2 Account Responsibility

You are responsible for:

Maintaining the confidentiality of your account credentials
All activity that occurs under your account
Providing accurate information in your profile
Notifying us immediately of any unauthorized use of your account

3.3 One Account per Person

Each user may create only one account. Accounts are personal and non-transferable.

4. Acceptable Use

You agree to use CalBuddy only for lawful purposes and in a manner consistent with these Terms. You must not:

Use the Service to harass, harm, or impersonate any person
Attempt to gain unauthorized access to our systems or other users' accounts
Reverse engineer, decompile, or disassemble any part of the Service
Use automated scripts, bots, or tools to abuse the Service
Submit false or misleading information
Use the Service in any way that violates applicable laws or regulations

5. Health & Medical Disclaimer

CalBuddy is a personal wellness and tracking tool only. It is not a medical device and does not provide medical advice.

Calorie and nutrition estimates generated by AI are approximations only and may not be accurate
CalBuddy is not intended to diagnose, treat, cure, or prevent any health condition
Do not use CalBuddy as a substitute for professional medical, dietary, or nutritional advice
If you have a medical condition, eating disorder, or specific dietary needs, consult a qualified healthcare professional before using this app
Calorie goals calculated during onboarding are general estimates and may not suit your individual health needs

6. AI-Generated Content

CalBuddy uses Google Gemini AI to analyze food photos and text descriptions. Regarding AI-generated nutrition estimates:

All nutrition values (calories, protein, carbs, fat) are estimates — not precise measurements
Accuracy depends on the quality of your photo or description
AI models can make mistakes — always cross-reference with official nutrition labels when precision is important
We are not responsible for decisions made based on AI-generated nutrition data

7. Buddy System

The buddy feature allows you to share your daily calorie summary with one trusted person. By using the buddy system:

You consent to sharing your daily calorie total and goal with your buddy
You are responsible for choosing your buddy — only share your buddy code with people you trust
Either party may remove the buddy connection at any time from the app
We are not responsible for how your buddy uses or interprets your shared data

8. Privacy

Your use of CalBuddy is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using CalBuddy, you consent to the collection and use of information as described in the Privacy Policy.

9. Intellectual Property

9.1 Our Rights

CalBuddy and its contents — including the app design, source code, branding, and features — are owned by us and protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the app for personal, non-commercial purposes.

9.2 Your Data

You retain ownership of all data you enter into CalBuddy (food logs, weight entries, etc.). By using the Service, you grant us a limited license to store, process, and display this data solely for the purpose of providing you with the Service.

10. Third-Party Services

CalBuddy integrates with third-party services including Supabase (database), Google Gemini API (AI analysis), Apple Sign-In, Google OAuth, and Open Food Facts (barcode lookup). Your use of these features is subject to those services' own terms and privacy policies. We are not responsible for the practices of these third parties.

11. Service Availability

We strive to keep CalBuddy available at all times but cannot guarantee uninterrupted access. We may temporarily suspend the Service for maintenance, updates, or circumstances beyond our control. We are not liable for any losses arising from Service downtime.

12. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT:

The Service will be error-free or uninterrupted
AI nutrition estimates will be accurate or complete
The Service will meet your specific requirements
Any errors in the Service will be corrected

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL CALBUDDY BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA LOSS, HEALTH-RELATED OUTCOMES, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.

Our total liability to you for any claims arising under these Terms shall not exceed the amount you paid us (if any) in the 12 months preceding the claim.

14. Indemnification

You agree to indemnify, defend, and hold harmless CalBuddy and its developers from any claims, liabilities, damages, and expenses (including reasonable legal fees) arising from your use of the Service, violation of these Terms, or infringement of any rights of a third party.

15. Termination

We reserve the right to suspend or terminate your access to CalBuddy at any time for violation of these Terms or for any other reason, with or without notice. You may terminate your account at any time by deleting it from the Profile screen.

Upon termination, all provisions that by their nature should survive (including disclaimers, limitations of liability, and indemnification) will continue to apply.

16. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by updating the "Last Updated" date. Your continued use of CalBuddy after changes constitutes your acceptance of the revised Terms. If you do not agree to the new Terms, you should stop using the Service.

17. Governing Law

These Terms are governed by and construed in accordance with the laws of Bulgaria, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Bulgaria.
